This End User License Agreement ("EULA") is a binding agreement between you ("you" or "User") and NVIAI Smart Technology Company Limited ("Meslingo", "we", "us", or "our"), the developer of the Meslingo application and related services (the "Application"). By downloading, installing, or using the Application, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the Application.
This EULA also incorporates our Terms of Service and Privacy Policy. In the event of a conflict between this EULA and those documents on a licensing matter, this EULA controls.
1. Acknowledgement
This EULA is concluded between you and Meslingo only, and not with Apple Inc. ("Apple"). Meslingo, not Apple, is solely responsible for the Application and its content. This EULA does not provide for usage rules for the Application that are less restrictive than, or in conflict with, the Apple Media Services Terms and Conditions / App Store Terms of Service (the "Apple Terms"). To the extent the Apple Terms are more restrictive, the Apple Terms govern.
2. Scope of License
Meslingo grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial purposes, on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Terms. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time, rent, lease, lend, sell, redistribute, sublicense, copy (except as expressly permitted), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application, except to the extent such restrictions are prohibited by applicable law.
3. Eligibility
You must be at least 13 years old to use the Application. If you are under the age of majority in your jurisdiction, a parent or legal guardian must agree to this EULA on your behalf and supervise your use.
4. Subscriptions, AI Points & Payments
Most features are free. AI features (AI Tutor chat, AI video call, writing and speaking grading, pronunciation scoring, Scan & Solve, and content generation) consume "AI Points".
- The Application offers auto-renewable subscriptions, Meslingo Pro and Meslingo Pro+, available as monthly, 6-month, and yearly plans, as well as one-time consumable "point packs". The exact title, duration, and price are shown in the Application before you confirm any purchase.
- Payment is charged to your Apple App Store account upon confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- You can manage or cancel a subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period. Deleting the Application does not cancel a subscription.
- Point packs are one-time purchases that do not expire and are non-refundable once delivered, except where required by law.
- Refunds and billing for App Store purchases are handled by Apple under its policies.
5. Maintenance and Support
Meslingo is solely responsible for providing any maintenance and support services with respect to the Application, as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. For support, contact support@meslingo.ai.
6. Warranty
The Application is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Meslingo's sole responsibility.
7. Product Claims
Meslingo, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Application's use of any AI features.
8. Intellectual Property Rights
In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Meslingo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. The Application, its branding, logos, curriculum, mini-games, and original content are owned by Meslingo or its licensors and protected by applicable laws.
9. AI-Generated Content
The Application uses third-party AI services to generate content (translations, role-plays, scoring feedback, generated lessons). AI output is provided as a learning aid only, may contain errors or omissions, and should not be relied upon as authoritative, especially for high-stakes use (legal, medical, or official exam answers).
10. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Third Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Application (for example, your wireless data services agreement and the terms of third-party services such as Google / Firebase used by the Application).
13. Third Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
14. Termination
This license is effective until terminated by you or Meslingo. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies.
15. Limitation of Liability
To the maximum extent permitted by law, Meslingo and its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application. Meslingo's total liability for any claim is limited to the amount you paid for the Application in the 12 months before the claim arose.
16. Governing Law
This EULA is governed by the laws of the jurisdiction in which Meslingo is incorporated, without regard to its conflict-of-laws principles, except as otherwise required by mandatory consumer-protection law in your country of residence.
